Licence terms for RF Lotse

Last updated: October 2026

1. Scope

These terms govern the use of the software RF Lotse (the "Software") by Jan Ralf Stürkat, Digital Smart Solutions, Erblandstr. 66, 51645 Gummersbach, Germany ("DSS"). For purchases in the Mac App Store, Apple's Standard Licensed Application End User License Agreement applies; for purchases in the Microsoft Store, its terms apply in addition.

2. Licence

On purchase, DSS grants you a non-exclusive, perpetual, non-transferable right to install and use the Software on computers you own or control. Resale is only permitted together with giving up your own use entirely, to the extent permitted by law.

3. Restrictions

You may not rent out, modify or reverse engineer the Software, except where expressly permitted by sections 69d and 69e of the German Copyright Act. Copyright and trademark notices must not be removed.

4. Third-party software

The Software contains components of other manufacturers under their own licences. They are listed in the app under "Licences" and take precedence over these terms to that extent.

5. Use of frequencies

The Software provides information and suggestions for frequency planning. It does not replace an official assignment or licence. You are responsible for ensuring that the frequencies you use are permitted and that you comply with the rules of the country concerned. The built-in information on manufacturer bands and allocations reflects the state of research; the documents of manufacturers and regulators are authoritative.

6. Warranty

Statutory provisions apply. For consumers, in particular sections 327 et seq. of the German Civil Code on digital products apply, including the obligation to provide updates.

7. Liability

DSS is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and within the scope of any guarantee given. For slightly negligent breach of an essential contractual obligation, i.e. one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. For loss of data, DSS is only liable to the extent that would have occurred with regular backups.

8. Data protection

The Software transmits no data to DSS. Details are given in the privacy policy.

9. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection of mandatory provisions of the country of their habitual residence. If the user is a merchant, the place of jurisdiction is Gummersbach. Should any provision be invalid, the remainder of the agreement remains valid.
